GIBBINS CHARGING STRUCTURE 2011

1. Legal Services Commission – Publicly Funded Matters:

Charges 5.5% on profit costs as drawn or, if hourly rates appropriate, charged at the LSC rates applicable.

Under the Unified Civil Contract, costs of preparing a bill for detailed assessment, a CLS CLAIM1 form or a High Cost Case Plan are now payable at the same hourly rate as all other preparation and in most cases our fee will covered by the amount claimed in the bill for this element.

Bill preparation forms part of the costs covered by a fixed fee applicable in Care cases and is not in addition to it.  Our charges for CLS CLAIM1A forms are 5.5% of the fixed fee plus advocacy.

High Costs Case Plans are charged on an hourly basis at the relevant  Public Funding rate; costs should be fully recoverable.

2. Privately Funded Matters:

 £110.00 per hour for preparing Bills & Schedules of Costs.

Usually the cost of preparing a Bill/Schedule will not exceed our former charge of 6% of the profit costs as drawn. Our time will continue to be charged within Bills/Schedules at Grade C or D rate, as applicable, which may result in Clients making a profit from utilising our services.

 3. Work in Connection with Detailed Assessment –

Points of Dispute / Replies / Skeleton Arguments /Interlocutory Hearings:

 £110.00 per hour.

 4. Costs Seminars:

 Either in your offices or at our Conference Suite here in Pontefract (charges to be agreed).

 5. Complex, unusual or novel matters:

 Charges by agreement

6. Pick up & Delivery

We provide a free collection and delivery service subject to geographical area – please contact us for details.

All above charges to be subject to VAT at the prevailing rate – 20% from January 2011.

Payment terms: 30 days, please.  Our preferred method of payment is by BACS – details available on request.

To facilitate prompt payment, may we suggest:

 

1. In LSC publicly funded matters, please claim payment of our invoice from the LSC as a disbursement, using a POA1, and so as to then enable you to pay our invoice promptly.

2. In privately funded matters, make arrangements in advance with lay Clients to fund payment of our invoice.
